Reasonable Modifications to Policies, Practices and Procedures

In a recent rule change to the DOT ADA regulations, the following new requirement is mandated for all public transit agencies:

“Public entities that provide designated public transportation (fixed route, demand responsive and complementary paratransit services) shall make reasonable modifications in policies, practices, or procedures when the modifications are necessary to avoid discrimination on the basis of disability or to provide program accessibility to their services.“

We will acquaint your agency with new requirements associated with this change such as the designation of a person to ensure compliance, the creation of a complaint system, and the use of alternative formats to educate the public on requesting a reasonable modification. We will also provide examples in the regulation as to what normally constitutes a reasonable request for a reasonable modification and those requests that do not meet approvable criteria.
