The Americans with Disabilities Act:
“A Big Picture View”
-One Day Course-
This course is an overview of the Americans with Disabilities Act (ADA) Title II as it is applied to transportation. The course begins with an introduction to the ADA in terms of nondiscrimination provisions for people with disabilities and then describes all regulatory requirements for the provision of service on fixed route, deviated fixed route and demand response service. Specific eligibility requirements for complementary paratransit service are covered along with ADA Complementary Paratransit Service Criteria as established in DOT regulations. Regulatory requirements established by the DOT and United States Access Board for transportation facilities are also covered. Finally, the course concludes with the importance of effective well documented policies for passengers with disabilities.Objectives:
- Understand the purpose of the Americans with Disabilities Act (ADA) as a major civil rights law
- Review Department of Transportation (DOT) regulations implementing the ADA
- Understand ADA nondiscrimination provisions
- Review DOT final rule changes to 49 CFR Part 37 regarding the definition of a wheelchair and reasonable modifications to policies, practices, procedures for greater accessibility
- Understand ADA requirements for the provision of service on fixed route and demand response buses
- Determine if an entity must provide ADA complementary paratransit service
- Understand ADA paratransit service criteria
- Review accessibility requirements for new and altered transit facilities
- Know the importance of reasonable modifications to policies to remove barriers to accessibility
- Understand ADA requirements for origin to destination service
- Discuss challenges resulting from the ADA
