ADA Policy and Regulatory Updates
-Half-Day Course-
During the past five years, numerous proposed and final regulatory changes have been made to the Americans with Disabilities Act, Title II. This course reviews proposed landmark revisions in 2010 to vehicle specifications by the United States Access Board, and final Department of Justice (DOJ) regulatory revisions in 2011 regarding service animals and Other Powered Mobility Devices. Also included is Department of Transportation (DOT) final revisions to their regulations in 2011 changing the definition of a wheelchair and the 2015 rule change requiring reasonable modifications to policies, practices and procedures for greater accessibility. A new Federal Transit Administration (FTA) Circular on ADA Guidance that was published on October 5, 2015 is also discussed.Objectives:
- Understand the purpose of the Americans with Disabilities Act (ADA) as a major civil rights law
- Review DOT and DOJ regulations implementing the ADA
- Understand ADA nondiscrimination provisions
- Review rule changes to vehicle specifications proposed by the United States Access Board
- Understand the differences between DOT and DOJ in defining a service animal
- Review DOT final rule changes to 49 CFR Part 37 regarding the definition of a wheelchair and reasonable modifications to policies, practices, procedures for greater accessibility
- Understand new ADA requirements for people in mobility devices
- Understand the major components of the FTA ADA Circular, October 5, 2015.
